A Hole In The Massachusetts Earned Sick Time Law

Being a leap year, there’s an extra day standing between us and spring. So, us New Englanders have to tough out winter even longer. February is the worst of the season and we’re still at the beginning. The cold temperatures usually mean that more of us are sick. CBS News recently reported that because the country has close to full employment, the places where we work have an increase in people, so the flu spreads even easier.

Whether it’s a cold, the flu or some other bug, there’s probably a lot of coughing, sneezing and sniffling where you work. Everyone says if you’re sick, don’t go in. Take a day or two off to rest and get better.

But that’s often easier said than done. Especially so soon after the holidays. Money spent on gifts may have left some in a fragile financial state and the holidays themselves may have been unpaid — further exacerbating the situation. Not all workers have paid holidays.

The time frame from the end of November through mid-January (Thanksgiving, Christmas, New Years and Martin Luther King, Jr. Day) often comes with several smaller weekly paychecks due to all the holidays. So taking unpaid time off at this time of year because of illness may not be an option. If anything, some workers may be trying to work extra time to make up for the money lost.

The Massachusetts Earned Sick Time Law is presumably meant to address most workers, but its focus is on permanent employees within larger companies – 11 employees or more. This law may seem fair on its face, but it’s not always fair in its application. Even though I had been working full time, one year, I ended up not having sick time available to use even though I earned it. Contract workers aren’t able to use sick leave in the same way (or sometimes at all) as permanent workers.

Contract vs Permanent

The term contract employee is used interchangeably with temporary employee. Both terms mean that the employee is hired via a contract for a particular job at a set rate of pay. This worker does not become part of the staff where they work and is not a permanent employee.

According to the American Staffing Association, about 17 million temporary and contract employees are hired each year in the United States by staffing companies. Most work full-time and enjoy having a flexible schedule. The average assignment is around two and a half months and can range from a few hours to several years.

Staffing statistics specific to Massachusetts give some insight as well. Annual sales are $4.3 billion. Each week, 68,100 temporary employees are part of the workforce in this state. Annually, that’s 354,200 people doing contract work in Massachusetts.

47% of these workers are in the engineering, IT and scientific sector. 15% are doing industrial work and another 15% are doing clerical and administrative work in an office. 7% are doing professional or managerial work. 12% are part of an uncategorized sector and 4% work in health care.

I’ve been a full-time contract attorney for many years, working at mostly large law firms in the Boston area. I’ve worked on dozens of projects. They have been as short as one day to as long as nearly four years. But as the previously stated statistics say, most recently, my projects have generally been two to three months.

To keep working steadily, I’m signed up with multiple agencies. Depending upon how long a project lasts, I might work for one agency for a year or more. Or I may work for several agencies for a few weeks and then for a few months. Most of these agencies I have worked with over many years. Each project may be new, but I am not a new employee. There is a work history.

The Problem: Using Massachusetts Sick Time

Earned sick time in Massachusetts provides that workers can earn and use up to 40 hours of sick time per year. Workers earn an hour of sick leave for every 30 hours worked. Employers can have their own policies providing more generous leave options than required by law.

Earning sick time isn’t the problem. The problem is using sick time that has already been earned. The regulations give some clarity. Sick time can’t be used until 90 days after the first date of actual work. Also, after a 12 month break in service, the 90-day vesting period starts again.

When a contractor is working on a project on average for about 75 days and works for multiple agencies, they may not return to the same agency for another year or more. In this scenario, the sick time that they earned is probably lost by the time they return to that employer.

This happened to me. It hasn’t happened often, but I went about one year where I couldn’t use the sick time that I had earned. By the next year, I had lost most if not all of it and had to start the 90 days again. This has also happened to colleagues. If this is happening to us, it might be happening to contractors in different sectors of the workforce as well.

According to the Institute for Women’s Policy Research, “approximately 728,000 private sector workers gained access to earned sick time under the law; of those, 431,000 workers lacked paid leave benefits of any kind (including vacation) and are newly eligible to receive leave under the law.”

The Solution: Amend The Law

I’m one of those workers who for the most part didn’t have paid leave benefits before this 2015 law. I’m grateful for it. But hindsight is 2020 and so is the year. Since we’ve had five years to see how this law works, I believe it’s time to take a closer look and amend the law, so it works for more of us.

However, there is another issue. Does anyone care? I’m attuned to the gaps in the law because I have firsthand experience. I was talking to a friend at work about this and she said that nobody cares how it impacts us. It felt quite hurtful, but maybe it’s true.

I plan to contact my state legislators about an amendment — and it may come to nothing. But at least I wrote this and raised the issue. Much like when I wrote about the gap in the Family Medical Leave Act when it comes to siblings. I want others in similar situations to know that they are not alone. It’s happening to other people as well. And even though it may not be most people, someone else does care.

Recently Watched: Being Erica

This past holiday season, I watched very few Christmas shows even though I look forward to them every year. But I enjoy time travel even more. And around Thanksgiving, I found a television series called Being Erica. I streamed the entire four years through the holidays and finished on December 30th. I wish there were more years, but watching this show was so satisfying —like eggnog and Christmas cookies. Which I indulged in while watching!

It was also a great way to end 2019. Especially since the year 2019 plays a role in the show, which aired on CBC Television from 2009 to 2011. So my then 2019 present, now my past in 2020, was the distant future on the show. How meta!

The easiest way to describe Being Erica is to compare it to Sex and the City. Located in Toronto instead of New York and with the added bonus of time travel! Erica is Carrie. She doesn’t have a Mr. Big, but she does have a series of romances and is a major part of the publishing world. We meet her group of close friends of course, but unlike Sex and the City, Erica’s family is a major part of the show. I always found it strange that we didn’t see Carrie’s family.

The way time travel works on this show is that it’s therapy. She meets Dr. Tom who gives her the ability to go back in time to regrets in her life and fix them. There are certain caveats to the time travel though. Which there always are!

This show has also made me realize a gaping hole in my Canadian travel. I’ve been to Canada a few times, but only to Montreal. I’ve never been to Toronto. It’s a new decade and before the 20s are over, I plant to visit! Hopefully I can get to some other places in Canada as well.

I won’t say more and give anything away, but I loved this show and was so glad that I found it streaming on Hulu. It’s also on Amazon Prime. The first episode is on YouTube, so you can watch it there for now too.

Recipe: Caramelized Apple Dutch Baby

Happy New Year! We’re living in the future! Well, actually the present. But that number — 2020. It seems like the future. Like when we were going from 1999 to 2000. It’s really just one day apart, but mentally it feels like a big jump. Going from one century to the next and one decade to the next. Also, now we’re really deep into the 21st century. It feels big.

So I decided to begin this first morning of the year and decade by doing something that I’ve been planning to do for quite some time. I made a Dutch baby for breakfast. These German pancakes were the darling of the food blogger world for many years. As I was reading yesterday, the main character in the novel just happened to make one. That sealed it for me.

A Dutch baby is similar to a popover, which I have made before. The dramatic thing about both is that they puff up without using any leavening. When I made popovers, they puffed up.

The Dutch baby did not puff. I have to admit that I was disappointed. Now I realize that the instructions in the recipe that I used didn’t stress using a blender or electric hand mixer to combine the ingredients. That vigorous mixing would have added more air prompting the puff. I forgot about this until looking at my popover recipe. Next time I’ll remember.

Also, just to let you know about the coloring. I keep a mixture of white flour combined with other healthier flours (ingredients) for better nutrition. The current combination is coffee flour and flaxseed meal. So the brown color of the Dutch baby might not be the same if you use plain white flour.

Single Serving Caramelized Apple Dutch Baby

INGREDIENTS:

Caramelized Apples:

  • 1 apple cut up
  • 1 T butter
  • 2 T brown sugar

Dutch Baby:

  • 1/4 cup flour
  • 1/4 cup milk
  • 1 T sugar
  • 1 egg
  • 1/4 tsp. vanilla extract
  • pinch salt
  • 1 T butter (for the skillet)

INSTRUCTIONS:

Preheat oven to 400°F.

Put the butter in a small skillet on medium heat and coat the sides. Add the apples and brown sugar. Stir and cook the apples for about 10 minutes. They will become tender and caramelized.

While the apples are cooking, combine the ingredients for the Dutch baby in a blender or use an electric mixer in a small bowl. Stirring with a whisk or a spoon is fine, but unless you whisk for longer than I did, it won’t be enough to get a lot of air into the mixture so that it will puff up in the oven.

Put the butter in a medium cast iron skillet on medium heat and coat the sides. When the butter sizzles, pour the batter into the pan and place in oven for 15 minutes.

Remove from the pan with a spatula and place on a large plate. Pour the apples on the Dutch baby. Sprinkle cinnamon and powdered sugar over the top. Enjoy!

Holiday Dessert Roundup: Mincemeat Pie

From my last few posts, it’s clear that I love holiday sweets. Gingerbread is a holiday staple and eggnog might be my favorite holiday treat. But there’s another one that I haven’t written about — mincemeat pie.

First, let me clarify. Most mincemeat pies do NOT have meat in them. They are made with dried fruits and spices. While we call them mincemeat in New England, apparently in most other places, they’re called mince.

Personally, I’ve never made a mincemeat pie. One of my mom’s sisters, is the pie maker for our holiday meals and we are often blessed with one of her mincemeat pies. After a brief Twitter exchange with someone, I realized that not all families are so blessed! We had one for Thanksgiving and I’m hopeful for Christmas too! Served warm with vanilla ice cream, it’s a carousel of delicious flavors and textures.

I started wondering if enjoying mincemeat pies is more of a regional thing. The pie does have its roots in England. Growing up in New England may have skewed my views. Although for a period of time, Connecticut banned mincemeat pies. Those Puritans were no joke.

Mincemeat pie is a holiday treat that has been enjoyed by many for a very long time, according to a recent article on Haiwatha World.

Mincemeat pie finds its roots in the 11th century — the Crusades, to be more precise. Returning crusaders brought back valuable spices — cinnamon, cloves and nutmeg — from the Holy Land, and these three spices were used to season a special “Christmas pie,” to represent the three gifts of the Magi to the infant Jesus Christ. Christmas pies were small, and could be eaten in a few bites. These pies were made in an oblong shape to resemble a cradle, and space was left for a Christ child figure to be placed on top. (The figure was removed before eating.) It was considered to be lucky to eat one Christmas pie for each of the twelve days of Christmas, between December 25 and Epiphany, January 6. The mincemeat filling of these pies was indeed almost entirely meat, but cooked with rum and spices, which acted as a preservative, as well as giving it its distinctive flavor.
